1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of the Vocals platform (usevocals.com), including the website, dashboard, APIs, and all related services (collectively, the "Service"). The Service is operated by Cashtanic S.L. (Tax ID: B22879217), with registered address at Calle Can Roqueta, 2, Ripollet, Barcelona, Spain.

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Vocals is an AI-powered telephony platform that automates phone calls using artificial intelligence voice agents. The Service includes, but is not limited to:

  • AI voice agent configuration and deployment for inbound and outbound calls
  • Call automation, recording, and transcription
  • CRM and third-party integrations (e.g., Google Calendar, HubSpot, custom webhooks)
  • Bring Your Own Keys (BYOK) for AI providers (e.g., OpenAI, Anthropic, Deepgram, ElevenLabs)
  • Analytics dashboard and call performance metrics
  • API access for programmatic agent management

3. Account Registration and Security

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Vocals immediately at contact@usevocals.com if you suspect any unauthorized access to or use of your account.

4. Acceptable Use

You agree to use the Service in compliance with all applicable laws and regulations. You must not:

  • Use the Service for any illegal, fraudulent, or deceptive purpose
  • Make harassing, threatening, or unsolicited calls
  • Violate telecommunications regulations applicable in your jurisdiction
  • Attempt to reverse engineer, decompile, or disassemble any part of the platform
  • Exceed rate limits, abuse the API, or attempt to circumvent usage restrictions
  • Impersonate another person or entity during automated calls

Vocals reserves the right to suspend or terminate accounts that violate these terms without prior notice.

5. Third-Party Integrations

Vocals integrates with third-party services including AI providers (OpenAI, Anthropic, Deepgram, ElevenLabs, and others), telephony providers, CRM systems, and Google Calendar. These third-party services are governed by their own terms of service and privacy policies.

If you use the Bring Your Own Keys (BYOK) feature, you are responsible for your own API keys and agreements with those providers, and third-party AI costs are billed directly by the respective providers. A Vocals subscription plan is still required to access the platform. If you do not use your own keys, Vocals provides access to third-party services as part of your plan, which may include a markup on usage costs. Vocals is not liable for service disruptions, changes, or issues caused by third-party providers.

6. Intellectual Property

The Vocals platform, including its software, design, branding, documentation, and underlying technology, is the property of Cashtanic S.L. and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without prior written authorization.

You retain full ownership of your data, call recordings, transcriptions, and configurations. By using the Service, you grant Vocals a limited, non-exclusive license to process your data solely for the purpose of providing and improving the Service.

7. Data and Privacy

The handling of your personal data is governed by our Privacy Policy. Call recordings, transcriptions, and metadata are stored under your account and are accessible to you through the dashboard.

You may request the deletion of your data at any time in accordance with the procedures described in our Privacy Policy. Upon account termination, your data will be handled according to the retention periods specified therein.

8. Payment and Billing

Vocals offers subscription-based plans with different tiers. By subscribing to a paid plan, you agree to pay the applicable fees as described on our pricing page. Billing is recurring and based on the billing cycle of your selected plan.

BYOK users pay their AI providers directly, but a Vocals subscription plan is still required to use the platform. Users on standard plans (without their own keys) receive access to third-party AI services through Vocals, which may include a markup on usage costs. A free tier with limitations is available. Vocals reserves the right to modify pricing with reasonable advance notice. Refunds are handled on a case-by-case basis; contact contact@usevocals.com for billing inquiries.

9. Service Availability

Vocals strives to maintain high availability of the Service but does not guarantee 100% uptime. Planned maintenance windows will be communicated in advance whenever possible. Vocals is not liable for downtime or service degradation caused by third-party providers, internet connectivity issues, or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Cashtanic S.L. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. This includes, but is not limited to, loss of profits, data, or business opportunities.

Vocals' total aggregate liability for any claims arising under these Terms shall not exceed the total fees paid by you to Vocals in the twelve (12) months preceding the event giving rise to the claim. Vocals does not guarantee the accuracy, completeness, or appropriateness of AI-generated responses during automated calls.

11. Termination

Either party may terminate this agreement at any time. You may close your account from the dashboard or by contacting contact@usevocals.com. Vocals may suspend or terminate your account if you breach these Terms or engage in activity that harms the Service or other users.

Upon termination, your right to access the Service ceases immediately. Your data will be retained and subsequently deleted in accordance with the retention periods described in our Privacy Policy.

12. Modifications

Vocals reserves the right to update or modify these Terms at any time. Material changes will be communicated to registered users via email or through the platform. Continued use of the Service after notification of changes constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Spain. For the resolution of any dispute arising from the use of the Service, both parties submit to the exclusive jurisdiction of the courts of Barcelona, Spain, expressly waiving any other jurisdiction that may apply.
